The www.cirquedepaname.com Site (hereinafter the “Site”) is the property of CDP ENTERTAINMENT, a French limited liability company with share capital of € 50,000. The company is registered at the Paris Commercial and Companies Registry under the number 849 690 722, and its head office is located at 55 avenue Marceau, 75016 Paris (hereinafter “CDP Entertainment”).
Upon entering the Site, Users’ personal data as defined per the Legislation (hereinafter the “Personal data”) are subject to being directly or automatically collected by CDP Entertainment.
Among the Personal data listed below, communication of the information followed by an asterisk “*” is compulsory for processing. Communication of the other data is optional and will be at the discretion of Users.
Personal data are collected when:
- Subscribing to regular or one-time newsletters that need Personal data:
– Name(s) and family name*
– Email address*
- For the purpose of getting in touch with an internal contact at CDP Entertainment (http://dev02.h-da.fr/contacts/) when necessary to communicate all Personal data required for the process of the User request and for the communication between himself and CDP Entertainment, that is to say, at a minimum, the following Personal data:
– Email address*
– Participating in possible offers or promotional events, operated directly through the Site or included in newsletters and that need communication of Personal data specified during the offer or said event.
CDP Entertainment has no access to the financial details of the User. Booking are made through a third party website not operated by CDP Entertainment and for which it has no control: https://cirquedepaname.fnacspectacles.com/place-spectacle/ticket-evenement/grand-spectacle-le-monde-de-jaleya-mancdp19-lt.htm.
Legality of processing
Personal data are used by CDP Entertainment in accordance with current data protection legislation.
Personal data processing is defined as legal when it meets at least one of the following conditions (including but not limited to):
- Where relevant Users have agreed to the processing of their Personal data for one of various specifics purposes;
- Where processing is necessary to execute the contract finalized between relevant Users and CDP Entertainment or to execute pre-contractual measures made at the User request;
- Where processing is necessary to respect a legal obligation to which CDP Entertainment is subject to;
- Where processing is necessary for the purpose of lawful interests pursued by CDP Entertainment.
Purposes of the processing
The Data detailed in the article 2 hereinabove are directly collected and processed by CDP Entertainment or through a subcontractor, for various purposes:

– Listing the Users who subscribed to various newsletters;
– Managing the subscriptions to various newsletters;
-Sending the corresponding newsletters to the subscribed Users
|Contacting CDP Entertainment|
-Managing the Users requests;
-Archiving the information provided until the definitive closing of the accounts (in case of litigation, until the end of the applicable limitation period);
– Communicating with the Users;
|Offers or promotional events||Managing the successful operations of the possible offers and promotional events, according to terms and conditions specific to each.|

Data retention period
Personal data are kept as long as it is necessary for the corresponding processing in accordance with the Legislation.
However, Personal data used to establish the proof of a right or a contract, or kept to comply with legal binding requirements can be subjected to a secured archive for a period that cannot exceed the period needed for the purposes for which they are being kept (including but not limited to those provided for in the commercial law, civil Code, consumer code, and accounting and tax provisions applicable to CDP Entertainment).
Regardless of whether the User unsubscribes or not to the various newsletters, Personal data used for commercial purposes can be kept for a period of three (3) years from the date of their collection or the latest contact coming from the prospect (the furthest date being retained). At the end of this period, CDP Entertainment will be able to re-contact the relevant User in order to determine if he/she wants to continue receiving commercial solicitation. Without any positive answer within 72 hours, CDP Entertainment will delete the data in accordance with the legislative and regulatory dispositions in effect.
Access to the Data
Some CDP Entertainment authorized employees are able to access all or part of Personal data.
People able to access Personal data are subject to a confidentiality agreement.
In addition, the CDP Entertainment subcontractors can have access to the whole or a proportion of Personal data as part of the following services (with this list not being exhaustive or final):
- Hosting of the Site (entrusted to OVH – 2 rue Kellermann 59100 Roubaix);
- Development and maintenance of the Site;
- Managing and sending of newsletters;
- Implementing and managing analysis and audience measurement tools.
As part of contractual relationships concluded between CDP Entertainment and its subcontractors, the latter agree to respect the Legislation and the whole of the obligations, including with regard to security protection and Data confidentiality.
All or part of Personal data can be provided to judicial and supervisory authorities as well as to the representatives of the law or judicial offers as part of their CDP Entertainment debt recovery and interest protection duty.
Your Data will be kept by CDP Entertainment within the European Union.
However, to the extent that some CDP Entertainment service providers and subcontractors are situated in third countries, outside the European Union, CDP Entertainment may transfer your Data to these countries.
Should it be the case, CDP Entertainment will ensure that this transfer is processed only in accordance with the Legislation, and guarantees a sufficient level of protection of your privacy and basic rights.
As a data controller, CDP Entertainment uses appropriate technical and organizational measures in accordance with the Legislation to protect itself by virtue of its best efforts against deterioration, accidental or illicit loss, and the use, disclosure or unauthorized access to Personal data.
In the event of a violation of Personal data likely to cause a breach of rights and liberties to one or various Users, CDP Entertainment will refer the said violation to the French data protection authority (CNIL) within the shortest time possible and at the latest, within the agreed period by the Legislation. If a violation of Data is likely to cause a serious breach of rights and liberties to one or various Users, CDP Entertainment will inform the relevant Users within the shortest time possible when this is technically possible unless otherwise specified in the Legislation.
Right to be informed
Users have the right to access their Personal Data and to request their rectification, completion or revision. Users can also request the erasure of their Personal data or object to their processing on legitimate and compelling grounds.
Upon notification by the User to perform such a request, CDP Entertainment agrees to bring said processing to a close within the shortest time possible, unless otherwise indicated by the Legislation.
Indeed, CDP Entertainment can keep some Personal Data when laws and applicable regulations to its activity make it necessary to do so or upon legitimate and compelling grounds.
Users can also request to receive their Personal data in a searchable format and request CDP Entertainment to transfer them to the designated third party(ies) when this is technically feasible.
Each User can also give instructions regarding the future of their Personal data in the event of their passing (Data retention, erasure or communication to a designated third party).
In order to exercise all or part of their rights, Users are invited to contact CDP Entertainment by sending an email to email@example.com or send a certified letter with return receipt requested to the following address: CDPE, 55 avenue Marceau, 75016 Paris, France.
CDP Entertainment could ask for a valid ID before complying with Users requests. CDP Entertainment will then make sure to answer these requests within the shortest time possible and, in any case within the agreed period by the Legislation.
In case of litigation when requesting implementation of their rights, Users have the right to make a complaint to the French data protection authority (CNIL): www.cnil.fr
Except for cookies that are strictly necessary for the use of the Site, the specific consent of the Users is collected by CDP Entertainment to set up cookies on their computer equipment, in accordance with the Legislation and other applicable dispositions, including Délibération No.2013-378 of 5 December 2013 adopting a recommendation on Cookies and other trackers referred to in Article 32-II of the Act of 6 January 1978.
Each User is informed about the presence of cookies on the Site through an information banner. By using the Site without readjusting your browser settings in order to block their installation, you expressly consent the installation of cookies on the Site.
The Users’ consent related to the setting of cookies has a (thirteen) 13-month validity period. At the end of this term or prior to the User removing cookies, it is required that the consent be renewed.
